1. About these Terms
These Terms of Service govern your access to and use of the FIGGI Beauty website and your purchase of products from us.

In these Terms, “FIGGI”, “FIGGI Beauty”, “we”, “us” and “our” refer to FIGGI BEAUTY LTD. “You” and “your” refer to the person accessing the website or purchasing products from us.
Please read these Terms carefully before using our website or placing an order.
By using the website, you agree to comply with these Terms. By placing an order, you confirm that you have read and accepted the Terms that apply at the time of your order.
These Terms should be read together with our:

Nothing in these Terms limits or excludes any statutory consumer rights that cannot lawfully be limited or excluded.

Information on our website and social-media channels is provided for general product and skincare information only. It is not medical advice and must not be treated as a substitute for advice from a doctor, dermatologist, pharmacist or other appropriately qualified healthcare professional.
Individual skin responses and results vary. Testimonials, customer feedback, consumer-perception results, clinical assessments and instrumental measurements do not guarantee that every customer will experience the same result.
Any stated timeframe for results is based on the relevant test, assessment or intended period of use and is not a guarantee of an individual outcome.

Stop using a product if you experience significant irritation, swelling, discomfort or an unexpected reaction. Seek medical assistance where appropriate.
Unless expressly stated otherwise, products are for external use only. Do not ingest products and avoid direct contact with the eyes.
Keep products out of the reach of children unless the product information expressly states that the product is suitable for use by children under adult supervision.
Nothing in this section excludes or limits our responsibility for a defective or unsafe product where that responsibility cannot lawfully be excluded.
9. Placing an order
The website allows you to select products and submit an order to purchase them.
Please review your order carefully before submitting it, including:

When you place an order, you are making an offer to purchase the products in accordance with these Terms.

A binding contract is formed when we send confirmation that your order has been accepted or when we dispatch the products, whichever occurs first.
10. Refusing or cancelling an order
We may refuse or cancel an order before dispatch where reasonably necessary, including where:

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products and any applicable delivery charge.
We may contact you to request additional information before accepting an order.
11. Order limits and resale
Products purchased through the FIGGI website are intended primarily for personal use.
We reserve the right to apply reasonable quantity limits and refuse orders that we reasonably believe are intended for unauthorised commercial resale, diversion or distribution.
Purchasing FIGGI products does not appoint you as an authorised retailer, distributor, representative, partner or agent of FIGGI.
You may not represent that you are officially connected with FIGGI or authorised to sell our products without our prior written agreement.
12. Prices and taxes
Product prices are displayed in the currency selected or shown on the website.
Unless clearly stated otherwise, prices shown to consumers include applicable taxes that we are required to charge at the time of purchase.
Delivery charges and any other applicable charges will be displayed before you submit your order.
We may change prices at any time, but a price change will not affect an order that we have already accepted.
Promotional prices apply only during the specified promotional period and are subject to the applicable promotional terms.
13. Pricing and website errors
Despite our reasonable efforts, a product may occasionally be listed with an incorrect price, description, promotion or availability status.
If an error is obvious and could reasonably have been recognised as an error, we are not required to supply the product at the incorrect price.
Where we identify an error before accepting your order, we may:

If we cancel an order after taking payment, we will refund the relevant amount.

Payment services may be supplied by third-party payment providers. Their own terms and privacy practices may also apply.
By submitting payment information, you confirm that:

We do not store complete payment-card details where payments are processed by an independent payment provider.

15. Promotional codes and offers
Promotional codes and offers:

Are subject to their specific terms;

Must be used before their stated expiry date;

May be restricted to particular products, territories or customers;

Cannot ordinarily be exchanged for cash;

Cannot be used retrospectively;

May not be combined unless expressly stated; and

May be withdrawn or corrected where issued or published in error.
You must not reproduce, sell, transfer or misuse a personal or restricted promotional code.
We may refuse a promotional code where it has expired, does not apply to the order, has already been used, or is being used fraudulently or contrary to its stated conditions.
Your statutory rights are not affected by a promotion or discount.
16. Gifts, sets and bundles
Products sold as a set, ritual, collection or bundle may be priced on the basis that they are purchased together.
Returns of sets, complimentary gifts and promotional products are governed by our Returns and Refunds Policy.
Where a complimentary product is offered subject to a minimum order value, the promotional terms may require the gift to be returned if a return causes the retained order value to fall below that minimum.
17. Delivery
We deliver to the destinations shown during checkout.
Estimated delivery dates and times are estimates unless we expressly agree to a guaranteed delivery date.
Delivery may be affected by circumstances outside our reasonable control, including:

Carrier disruption;

Adverse weather;
-
Industrial action;

Transport disruption;

Public emergencies; or

Incorrect or incomplete delivery information.
We will take reasonable steps to keep you informed of a material delay that becomes known to us.
Unless another delivery period has been expressly agreed, we will deliver within the period required by applicable consumer law.
18. Delivery address and customer responsibility
You are responsible for supplying a complete and accurate delivery address.
Please check the address carefully before submitting your order.
Contact us promptly if you notice an error. We cannot guarantee that an address can be changed after an order has entered the fulfilment or delivery process.
Where an order cannot be delivered because you supplied an incorrect or incomplete address, failed to collect it, or refused it without validly notifying us of cancellation, we may charge or deduct actual and reasonable redelivery or return costs where legally permitted.
We will not charge you for a delivery failure caused by FIGGI or our delivery provider.
19. Risk and ownership
Risk in the products passes to you when the products are delivered to you or to a person identified by you to receive them.
Ownership of the products passes to you once we have received payment in full and the products have been delivered.
This does not affect your rights if a product is lost, damaged or incorrectly delivered.
20. International deliveries, customs and import charges
The checkout page will indicate the territories to which we currently deliver and the charges collected by us.
Depending on the destination and delivery arrangement, an order may be subject to local import VAT, customs duties, handling fees or other governmental charges.
Where these charges are not expressly included and collected by FIGGI at checkout, they may be payable by the recipient.
We will aim to make the applicable delivery arrangement clear during checkout or in our Shipping Policy.
You are responsible for complying with lawful import restrictions in the delivery country.
We are not responsible for customs delays outside our reasonable control. This does not affect mandatory consumer rights concerning delivery or non-delivery.
21. Right to cancel and return products
Consumers in the United Kingdom and European Union may have a statutory right to cancel eligible online purchases.
The applicable cancellation procedure, return deadlines, cosmetic hygiene restrictions, responsibility for return shipping costs and refund process are explained in our Returns and Refunds Policy.
Our Returns and Refunds Policy forms part of these Terms.
Customers are responsible for arranging and paying return shipping for eligible change-of-mind returns, as explained in the Returns and Refunds Policy.
Nothing in these Terms or our Returns and Refunds Policy removes rights available to you in relation to products that are faulty, unsafe, damaged, incorrectly supplied or not as described.
22. Faulty or misdescribed products
We are under a legal duty to supply products that comply with the contract and applicable consumer law.
Products must be as described, of satisfactory quality and fit for any purpose expressly agreed with us, subject to the rights and standards applicable in your country.
Contact us at sales@figgi.eu if you believe a product is faulty, unsafe, damaged or not as described.
Depending on the circumstances and applicable law, you may be entitled to a refund, replacement, repair where appropriate, price reduction or another remedy.
Nothing in these Terms limits those statutory rights.
23. Product recalls and safety notices
If we become aware of a product-safety concern, we may contact affected customers using the contact details provided with their order.
You must follow any reasonable safety or product-recall instructions we provide.
Where a recall applies, stop using the affected product if directed and follow the return or disposal instructions provided.
Any recall remedy will be provided in accordance with applicable law and the circumstances of the recall.
24. Intellectual property
All intellectual-property rights in the website and its contents belong to FIGGI, our licensors or other lawful rights holders.
This includes, where applicable:

The FIGGI and FIGGI Beauty names;

Logos and trademarks;

ASPALUX3™ and other brand identifiers;

Product names;

Packaging designs;

Photographs;

Videos;

Illustrations;

Software and website code.
You may access and use the website for personal, non-commercial purposes.
Without our prior written permission, you must not:

Copy or reproduce substantial website content;

Republish our photographs, copy or designs;

Use our branding to suggest an affiliation or endorsement;

Modify, distribute, sell or commercially exploit website content;

Scrape or systematically extract website data;

Remove copyright, trademark or ownership notices.
Nothing in these Terms transfers ownership of our intellectual property to you.
25. Reviews, feedback and customer content
You may submit genuine reviews, photographs, comments or other content where the website allows this.
You retain ownership of content you create. By submitting content to us for publication, you grant FIGGI a non-exclusive, worldwide, royalty-free licence to store, reproduce, publish, format and display that content for the operation and promotion of FIGGI and its products.
This licence does not permit us to materially misrepresent what you said or falsely attribute an endorsement to you.
You confirm that content submitted by you:

Reflects your genuine experience or opinion;

Is accurate to the best of your knowledge;

Does not infringe another person’s rights;

Is not defamatory, unlawful, threatening or discriminatory;

Does not contain malicious code;

Does not disclose another person’s private information without permission; and

Is not a fake, undisclosed commercial or misleading review.
Where a review was submitted in connection with an incentive, gift or commercial relationship, this must be clearly disclosed.
We may moderate, reject or remove content where we reasonably believe it is unlawful, fraudulent, misleading, irrelevant, abusive, infringing or contrary to these Terms.
We will not remove a genuine negative review merely because it is unfavourable.
26. Prohibited use
You must not use the website:

We may suspend access, cancel affected orders and report suspected unlawful conduct where reasonably necessary.

Where consent is legally required for non-essential cookies or direct marketing, you may provide or withdraw that consent using the options made available to you.
29. Our responsibility to consumers
We are responsible for losses that you suffer where those losses are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
A loss is foreseeable if it was an obvious consequence of our breach or if both you and we knew that it might occur when the contract was formed.
We do not exclude or limit liability where doing so would be unlawful.
Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence;

Fraud or fraudulent misrepresentation;

Defective or unsafe products where liability cannot lawfully be excluded;

Breach of your statutory consumer rights; or

Any other liability that cannot lawfully be limited or excluded.
30. Losses for which we are not responsible
Subject to Section 29, we are not responsible for:

Losses that were not foreseeable;

Loss caused by your misuse of a product;

Loss caused by your failure to follow product directions or warnings;

Loss caused by an undisclosed allergy or sensitivity where the product was correctly labelled and not defective;

Loss caused by unauthorised modification, contamination or improper storage after delivery;
-
Loss resulting from circumstances outside our reasonable control where we took reasonable steps to minimise the effect; or
-
Business losses arising from a consumer purchase, including loss of profit, revenue, opportunity or business interruption.
This section does not apply where the loss results from our negligence, breach of contract, defective product or another legal responsibility that cannot be excluded.
31. Consumer purchases
These Terms are principally intended for customers purchasing products as consumers.
If you purchase products wholly or mainly for business purposes, different legal rules may apply.
Unless we have entered into a separate written business agreement with you, we do not accept responsibility for business losses such as loss of profits, revenue, contracts, anticipated savings, goodwill or commercial opportunity, except where liability cannot lawfully be excluded.
32. Events outside our reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control, provided that we:

Take reasonable steps to minimise the effect;

Resume performance as soon as reasonably possible; and

Do not use this section to avoid obligations that remain mandatory under consumer law.
Such events may include severe weather, fire, flood, epidemic, governmental action, transport disruption, industrial disputes, telecommunications failure or interruption to essential third-party infrastructure.
If a delay becomes substantial, you may have the right to cancel and receive a refund for products not supplied.
33. Suspected fraud and misuse
We may use reasonable fraud-prevention and payment-verification measures.
Where we reasonably suspect fraud, payment misuse, unauthorised resale, account compromise or other unlawful conduct, we may:

Refuse or cancel an order;

35. Alternative dispute resolution
We are not required to participate in a particular alternative dispute-resolution procedure unless applicable law requires us to do so or we expressly agree to participate.
This does not prevent you from contacting a relevant consumer-protection body or bringing a claim before a court with jurisdiction.
36. Governing law
These Terms and contracts for purchases from FIGGI are governed by the laws of Scotland.
However, if you are a consumer residing elsewhere in the United Kingdom or in a European Union member state, this choice of law does not deprive you of mandatory consumer protections that apply in the country in which you habitually reside.
37. Courts and jurisdiction
If you are a consumer living in Scotland, the Scottish courts will have jurisdiction over disputes, although another court may have jurisdiction under applicable law.
If you are a consumer living elsewhere in the United Kingdom or European Union, you may bring proceedings in any court that has jurisdiction under applicable consumer law, including the courts of your country of residence where the law permits.
Nothing in these Terms requires a consumer to bring a claim exclusively in Scotland where that requirement would be unlawful or unfair.
38. Severability
If a court or competent authority finds that any provision of these Terms is unlawful, invalid or unenforceable, that provision will be treated as modified to the minimum extent necessary or removed where modification is not possible.
The remaining provisions will continue in effect.
39. No waiver
If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.
A waiver will be effective only in relation to the particular circumstances for which it was given.
40. Transfer of rights
We may transfer our rights and obligations under these Terms to another organisation as part of a genuine sale, restructuring or transfer of our business, provided that this does not reduce your contractual or statutory rights.
You may transfer your rights under a purchase contract where the law permits or where we agree in writing.
41. Third-party rights
Unless expressly stated otherwise, these Terms are between you and FIGGI.
No other person has a right to enforce these Terms except where applicable law provides otherwise.
42. Entire agreement
These Terms, together with the policies expressly incorporated into them, form the agreement between you and FIGGI concerning your use of the website and purchases made from us.
Nothing in this section excludes liability for fraud or prevents reliance on rights or statements that cannot legally be excluded.
